Payments Terms
MIAMI POOL CONSULTANTS, DOING BUSINESS AS POOL AI · LAST UPDATED: NOVEMBER 2026
In short
- Payments are optional. When you turn them on, you get your own Stripe account. Your customers pay you, and you're the seller (merchant of record).
- Each payment costs Stripe's processing fee plus Pool AI's 1%. At Stripe's standard US prices that's 3.9% + 30¢ per card payment and 0.8% + 1% per bank (ACH) payment, never more than $15 in total. There's no monthly fee.
- You choose who pays the processing fees: you or your customer, with a default you can change for each customer. A customer is never charged a fee on debit or prepaid cards; on credit cards it can't be more than the card networks allow, and it's never added where state law forbids it.
- Stripe pays the money into your bank account. Refunds, disputes and chargebacks on your customers' payments are your responsibility.
- Stripe's Connected Account Agreement also applies to you.
1. What these terms cover
These Payments Terms add to the Pool AI Terms of Service. They apply to any pool company ("you") that turns on customer payments in Pool AI Pro. Customer payments include:
- invoices paid on the customer's private page;
- AutoPay;
- deposits;
- quote payments.
Your own Pool AI subscription is covered by the Terms of Service and the Cancellation & Refund Policy, not by these terms.
2. Stripe and your connected account
- Who processes payments. Payments are processed by Stripe through Stripe Connect. To accept payments, you create your own Stripe connected account, and Pool AI helps you do it.
- Stripe's agreements. You must accept the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (together, the "Stripe Terms"). Stripe may change the Stripe Terms from time to time.
- Identity checks. Stripe checks your identity and business, as financial regulations require. It may ask for information about your business and its owners.
- Information we share with Stripe. You allow MPC to share with Stripe the information needed to set up and run your account, and to receive information from Stripe about your transactions and payouts so we can show it in Pool AI Pro.
- You are the merchant of record. Your customers pay your business, and the charges appear in your Stripe account. MPC doesn't hold your customers' money. MPC is not a bank, money transmitter or payment processor.
- Card and bank numbers. Card and bank details are entered directly into Stripe's secure forms. They never reach Pool AI's servers. Don't type card numbers into notes, messages or photos in Pool AI.
3. Fees
| Payment type | Pool AI fee |
|---|---|
| Card, including Apple Pay, Google Pay and Link | 1% of each successful payment, on top of Stripe's card fee (Stripe's standard US price is 2.9% + 30¢, so 3.9% + 30¢ in total) |
| Bank payment (ACH) | 1% of each successful payment, on top of Stripe's bank fee (Stripe's standard US price is 0.8%, never more than $5). Stripe's fee and our fee together are never more than $15 per bank payment; above that we lower our fee. |
| Other methods we add later | Shown in Pool AI Pro before you turn the method on |
| Monthly fee for payments | None |
- How the fees are collected. Our 1% is taken automatically from each payment as a Stripe application fee. Stripe takes its own processing fee from the payment under the Stripe Terms. You receive the rest. Together, Stripe's fee and our 1% are the processing fees.
- Other Stripe charges. Stripe may charge for things outside the table above, such as disputes, failed or returned bank payments, instant payouts or currency conversion. Any such charge is taken from your Stripe balance under the Stripe Terms.
- Fee changes. We may change our fees with at least 30 days' notice by email and in Pool AI Pro. Founding-member price locks cover your monthly plan, not payment fees, unless your account says otherwise.
4. Who pays the processing fees
You set a default when you set up Pool AI Pro (you can change it in Settings → Payments), and you can change it for each customer:
- You pay the fees. Your customer pays the invoice amount, and the processing fees come out of what you receive. This is the standard setting.
- Your customer pays the fees. On a card this is also called a surcharge. Pool AI adds a processing fee to the customer's total, sized so that you receive about the invoice amount. If you choose this option, Pool AI applies the following rules automatically, and you agree to them:
- On cards, the fee is added only to credit card payments, never to debit or prepaid cards. On bank (ACH) payments the customer pays Stripe's bank fee plus our 1%. It's never added to other methods.
- On a credit card it's never more than the lowest of: the card networks' maximum (currently 3% for most US networks), the cap the law sets where your customer's service address is, and the actual processing fees.
- It isn't added at all where the law of your customer's service address doesn't allow it. Pool AI keeps a list of those places and treats unclear ones as not allowed.
- The customer sees the fee before paying, and it appears on the receipt.
Where a limit means your customer pays less than the processing fees (for example a debit card, the 3% cap, or a state that doesn't allow it), you pay the difference out of the payment.
You're responsible for surcharging lawfully in your area. That includes any notice the card networks or your state require, and making sure that your quotes, signs and invoices match.
5. Bank payments (ACH) and AutoPay
- Bank payments. The customer authorizes the bank debit through Stripe's mandate. Bank payments take several business days to complete. If a bank payment fails or is returned, the invoice opens again, and we tell you and the customer.
- AutoPay. A customer can turn on AutoPay to let you charge their saved card or bank account for future invoices. You may charge AutoPay only for work that is completed and an invoice you approved, and only for amounts that match your agreement with the customer. The customer can turn AutoPay off at any time on their page. You must stop charging when they do.
- Card-network and bank rules. You agree to follow the rules for recurring and stored-card payments and the Nacha rules for bank debits. Pool AI is built to help you do this.
6. Payouts
Stripe pays your available balance into the bank account you added to your Stripe account. It uses Stripe's payout schedule for your account. Stripe may delay payouts, hold funds or keep a reserve if it sees risk, for example many disputes or unusual activity. Holds and reserves are decided under the Stripe Terms. MPC doesn't hold your payouts and doesn't earn interest on your money.
7. Refunds
- You decide refunds. You decide whether to refund your customers, under your own policy and the law. You can refund all or part of a payment from the invoice in Pool AI Pro or from Stripe.
- Our fee on a refund. When you refund a payment, we return our fee in proportion to the amount refunded. Any processing fee your customer paid is also refunded in proportion.
- Paying for refunds. Refunds are paid from your Stripe balance. If your balance is too low, Stripe may debit your bank account under the Stripe Terms.
8. Disputes and chargebacks
- When a customer disputes a payment with their card issuer or bank, the dispute is between you and your customer.
- You're responsible for the disputed amount and for any dispute fee Stripe charges.
- You can respond and send evidence through Stripe, and we'll help where we can. For example, Pool AI keeps the customer's confirmation that the work was done, visit reports and photos, which can support your response.
- If your account has too many disputes, Stripe or MPC may limit or turn off payments for your company.
9. Your responsibilities
- Use payments only to collect money your customers owe for your own pool services and products.
- Don't use payments for any business Stripe doesn't allow, for cash advances, or to process payments for another business.
- Describe your charges clearly and keep your business name and contact details current, so customers recognize the charge.
- Handle sales tax and income tax on the payments you receive. Stripe may send you a tax form (such as Form 1099-K) when the law requires one.
- Follow the law, the Stripe Terms and card-network rules.
10. Turning payments off
You can turn customer payments off at any time. MPC may suspend payments for your company if you break these terms, if Stripe restricts your account, if you have excessive disputes, or if we need to protect customers. Where we can, we'll give notice first. Your Stripe account is yours, and it continues under the Stripe Terms even if you stop using Pool AI.
11. Liability
MPC isn't responsible for decisions Stripe makes about your account. That includes holds, reserves, verification and account closure. MPC also isn't responsible for delays at banks or card networks. The limits of liability and the indemnity in the Terms of Service apply to payments.
