Terms of Service
MIAMI POOL CONSULTANTS, DOING BUSINESS AS POOL AI · LAST UPDATED: NOVEMBER 2026
In short
- Homeowners can use Pool AI and Blue for free. Pool companies listed in Pool AI are independent businesses. We don't do their work or guarantee it.
- Pool companies pay monthly for Pool AI Pro. Setup is free and the first month is free. There's no contract, and you can cancel anytime. After you cancel, you keep access until the end of the month you paid for.
- We give 30 days' notice before a price goes up. Founding-member price locks are always honoured.
- Your customer data belongs to you. We only use it to run Pool AI for you. We never sell it and never use it to train AI models.
- Blue is an AI and can make mistakes. Always test your water and follow the product label. Never mix chemicals.
- Florida law applies. Most disputes go to individual arbitration, not class actions, and you can opt out within 30 days (section 23).
This summary helps you read the terms. The full text below is what applies.
1. Who we are and what these terms cover
Pool AI is run by Miami Pool Consultants ("MPC", "we", "us", "our"), a Florida corporation doing business as Pool AI. These Terms of Service ("Terms") are an agreement between you and MPC. They cover all of the following (together, the "Services"):
- the Pool AI app for homeowners, including Blue, our pool AI;
- the private pages that pool companies give their customers;
- Pool AI Pro, the software for pool service companies and their staff. It includes customers, routes, visit reports, invoices and AutoPay, quotes, work orders, team tools, the Inbox, company websites, directory listings and Blue AI helpers;
- Blue chat on company websites;
- the website mpcpoolai.com and the Pool AI directory at mpcpoolai.com/pros.
By creating an account, clicking to accept, or using the Services, you agree to these Terms. If you use Pool AI Pro for a business, "you" means that business, and you confirm you have authority to accept for it.
These additional policies are part of these Terms:
- our Privacy Policy;
- our Acceptable Use Policy;
- the Blue & AI Terms;
- the Cancellation & Refund Policy;
- the Directory & Reviews Guidelines;
- for companies that collect payments, the Payments Terms;
- for business customers, the Data Processing Addendum.
If one of those documents conflicts with these Terms on its specific topic, that document controls.
Pool AI is currently offered in the United States. We plan to offer it in other countries later. When we do, local terms may be added for those countries.
2. Accounts and who can use Pool AI
- You must be at least 18, or the age of majority where you live. Pool AI is not meant for children. We don't knowingly collect personal information from children under 13.
- Give us accurate information and keep it up to date.
- Keep your sign-in details private. You're responsible for activity on your account. Tell us right away at info@mpcpoolai.com if you think someone else has used it.
- Company accounts:
- The company owner controls the company's account.
- The owner decides who on the team gets access and what role each person has.
- The company is responsible for everything its team members do in Pool AI Pro.
- When someone leaves the company, remove their access.
3. Homeowners and customers of pool companies
- Free to use. The Pool AI app and Blue are free for homeowners. We may add optional paid features later. If we do, we'll show the price before you buy anything.
- Pool companies are independent. They are not our employees or agents. Each company is responsible for its own work, licenses, insurance, prices, schedules and conduct. We don't guarantee any company's services, even when a company shows a verification badge. The Directory & Reviews Guidelines explain what the badge means.
- Your agreement for pool service is with your pool company, not with us. This covers prices, the service itself, cancellations and refunds. If you pay your pool company through Pool AI, the company is the seller, and the payment is processed by Stripe.
- Sending your details to a company. When you ask us to, we send your details to the company you choose. What happens after that is between you and that company.
- Emergencies. Pool AI is not an emergency service. For fire, injury, or someone in danger in the water, call 911 or your local emergency number first.
4. Pool AI Pro subscriptions
- Plans and prices. Our plans and prices are listed on our pricing page and in your account when you subscribe. Today they are:
- Pool AI Solo: the owner plus one office user.
- Pool AI Pro: the owner is free and you can add unlimited team users at no extra cost. Blue's fair-use limits apply (section 9).
- Build your own: you pick the features you need. The Team feature includes 25 team users; each extra user costs a small monthly amount.
- Free setup and first month free. Setup is free, and your first month is free. We'll remind you before your first paid month starts.
- Billing.
- After the free month, your plan is billed monthly in advance to the card you saved. Stripe processes the charge.
- Your subscription renews each month until you cancel.
- When you add users, ZIP codes or features, the new charge appears on your next bill. If Stripe prorates a mid-month change, the prorated amount is billed.
- Prices don't include taxes. If a tax applies, we add it.
- If a payment fails. We'll tell you and Stripe will retry. If your plan stays unpaid after the free month or after a failed payment, your account becomes read-only. You can still see and export your data, but you can't add new work until the bill is paid. We don't delete your data just because a payment failed. Section 19 explains what happens to your data after an account ends.
- Founding members. The first 5 companies to subscribe keep their monthly price for life. The next 25 keep it for 24 months from the day they join. A founding price stays locked as long as the subscription stays active. If you cancel and come back later, current prices apply. Your Account page shows your founding status.
5. Price changes
We may change our prices. Before any increase reaches you, we'll email the company owner and show a notice in Pool AI Pro at least 30 days ahead. The new price applies from your first billing date after the notice period ends. If you don't want the new price, you can cancel before then. Price decreases can take effect right away. Founding-member locks are honoured whatever we change.
6. Cancellation and refunds
You can cancel anytime: in Pool AI Pro open Account and tap Cancel my plan, or email info@mpcpoolai.com from the owner's email address.
- You keep access until the end of the month you already paid for. After that, you aren't charged again.
- We don't refund partial months, except where the law requires a refund or as described in our Cancellation & Refund Policy. For example, we refund charges made by mistake.
Cancelling Pool AI Pro doesn't cancel the agreements you have with your own customers. Tell them how they'll pay you from now on and how they'll reach you.
7. Payments you collect from your customers
Pool companies can choose to collect customer payments through Pool AI. This works through Stripe Connect.
- Each company has its own Stripe connected account, and the company is the merchant of record for its customers' payments.
- Our fees, AutoPay, refunds, disputes and card-fee rules are in the Payments Terms.
- To use payments, you must also accept Stripe's Connected Account Agreement, which includes the Stripe Services Agreement.
You don't have to use Pool AI payments. You can keep using checks, bank transfers or your own processor.
8. Your data and our permission to use it
- Customer data belongs to the company. This covers the customers, pools, visits, photos, readings, messages, quotes, invoices and team records that a company enters into Pool AI Pro (together, "Customer Data"). The company owns it and controls it.
- What we do with Customer Data. We process it only on the company's behalf, to:
- provide, secure, support and improve the Services;
- follow the company's instructions;
- comply with the law.
- Permission you give us. You give MPC a limited, non-exclusive, worldwide permission to host, copy, process, translate, transmit and display your content, only as needed for the purposes above. This permission ends when your content is deleted from Pool AI. Copies in backups age out on their normal schedule.
- Statistics. We may create statistics that are aggregated and de-identified, meaning they can't identify you, your company or your customers. An example is "average time per pool visit". We use them to run and improve Pool AI.
- What we never do. We don't sell personal information. We don't use Customer Data for advertising. We don't use your content to train AI models.
- Homeowners' own data. When a homeowner uses the Pool AI app directly, MPC decides how that data is used, as explained in our Privacy Policy. If a homeowner asks us to send their details to a pool company, that company then also holds a copy.
- Your responsibilities. You confirm you have the right to enter the information you put in Pool AI. You also confirm that you give your customers and staff any notices the law requires, and get any consents it requires.
- Getting your data and deleting it. You can export your customer list from Pool AI Pro. You can also ask us for a copy of your other records. After your account ends, we keep your data for at least 90 days so you can still get it, and then we may delete it. Records the law requires us to keep are kept until that requirement ends.
9. Blue and other AI features
Blue and the other AI features in Pool AI (answers, photo reading, translations, email summaries, draft replies and website text) are generated by artificial intelligence. They can be wrong. They give general information, not professional advice.
- Always test your water and follow the product label.
- Never mix chemicals.
- Use a licensed professional for electrical, gas or structural work.
- Pool companies must review AI drafts and translations before sending them.
- Fair use. Unlimited users means unlimited logins, not unlimited AI. Blue is for your company's normal pool-service work. To keep Blue fast and fair for everyone, each company has daily limits on Blue's answers, photo and document readings, and the emails Blue reads. When a limit is reached, Blue starts fresh the next day and the rest of Pool AI keeps working. If one company's use is far above normal, we may ask it to reduce its use or talk with it about a plan that fits.
The full rules are in the Blue & AI Terms.
10. Team members, location tracking and the Inbox
- Location tracking. If a company turns on route tracking, Pool AI Pro records a tech's location while they're clocked in or on their route. Tracking stops when they clock out. The company decides whether to use tracking. Before turning it on, the company must tell its techs and follow applicable employment and privacy laws, including getting consent where it's required.
- The Inbox. Owners and office staff can connect a business mailbox (Gmail, Google Workspace, Outlook or Microsoft 365) through the provider's own sign-in. By connecting one, you confirm you're allowed to give Pool AI access to it. Pool AI's use of information received from Google APIs follows the Google API Services User Data Policy, including the Limited Use requirements. If you disconnect the mailbox, Pool AI's copies of your email are deleted.
- Hours and pay. Payroll, time-clock and billing tools help you keep records. They aren't accounting, tax or legal advice, and you're responsible for your own payroll and taxes.
11. Messages and email you send through Pool AI
- Use Pool AI messaging and email only to contact your own customers, leads and team about your services.
- Follow the laws that apply to commercial email, such as CAN-SPAM in the US. Honour unsubscribe requests.
- Pool AI doesn't send text messages (SMS).
- Automatic translations can contain mistakes. You're responsible for what you send. The original text always stays available.
12. Directory listings and reviews
Listings at mpcpoolai.com/pros and in the Pool AI app follow the Directory & Reviews Guidelines:
- a ZIP code shows up to 3 companies;
- the guidelines explain what the verification badge means, who can leave a review, and when we remove a listing or a review.
Companies must not:
- post fake reviews, or pay for or reward positive reviews;
- pressure customers to change or remove a review.
13. Company websites and your content
- You're responsible for your website. Pool AI Pro can build a website for your company. You're responsible for everything on it, including text Blue wrote for you. Check that your services, prices, licenses, insurance, service areas, photos and claims are true and up to date.
- Content you have rights to. Only upload logos, photos and text that you own or have permission to use.
- Your website's legal notices. If your site collects information from visitors (for example, quote requests), you're responsible for your own legal notices to them. Our Privacy Policy covers how Pool AI handles that data for you.
- Removal. We may remove content that breaks these Terms or the law, or that someone credibly reports as infringing.
14. Acceptable use
You agree to follow our Acceptable Use Policy. In short:
- no illegal activity;
- no attempts to break our security;
- no scraping or reselling the Services;
- no spam;
- no pretending to be someone else;
- no using Blue to produce harmful content.
15. Third-party services
Pool AI works with outside services, for example:
- Stripe (payments);
- Anthropic (AI);
- Google and Microsoft (Inbox);
- Intuit QuickBooks (accounting);
- Google Play (the Android apps).
The current list, with links to each provider's terms and privacy policy, is on Services we use. When you connect or use a third-party service, its own terms also apply. We aren't responsible for third-party services we don't control. If you got a Pool AI app from Google Play, Google Play's terms also apply, but Google isn't responsible for the app.
16. Our intellectual property and your feedback
MPC owns the Services, including the software, designs, the Pool AI and Blue names and logos, the knowledge base and our documentation. While you follow these Terms, you may use the Services for their intended purpose. You may not copy, modify, reverse-engineer or resell them, except where the law allows. If you send us ideas or feedback, we may use them without any obligation to you.
17. Copyright complaints
If you believe content on Pool AI (for example, on a company website) infringes your copyright, email info@mpcpoolai.com with the subject "Copyright notice". Include:
- your contact details;
- the work you own;
- the exact page or address of the content;
- a statement that you believe in good faith the use isn't authorized;
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner;
- your physical or electronic signature.
Copyright notices can also be mailed to the address below. We'll remove or disable material that infringes. We'll end the accounts of people who repeatedly infringe.
18. Availability, changes and beta features
We work to keep Pool AI available and accurate, but we don't promise it will always be available or free of errors. We may add, change, pause or remove features. If we remove a major paid feature, we'll give reasonable notice. If the removal significantly reduces what you're paying for, you may cancel and we'll refund the unused part of that month.
Features labelled "beta", "preview" or "new" may be incomplete and may change or stop. Use them knowing that.
19. Suspension and termination
- Ending your account.
- Homeowners can delete their account in the app (My Pool → Delete my account).
- Companies can cancel as described in section 6.
- When we may suspend or close an account. If any of the following happens, we may suspend or close the account. Where it's reasonable, we'll give notice first and a chance to fix the problem.
- You break these Terms or the Acceptable Use Policy.
- You don't pay.
- Your license or insurance lapses (for listed companies).
- We need to suspend or close the account to protect users, the Services or the public.
- The law requires it.
- If we stop offering the Services. We'll give at least 30 days' notice, so you can export your data, and we'll refund any amount you prepaid for time after the Services end.
- After an account ends.
- Access ends.
- Your data is handled as described in section 8.
- Sections that by their nature should continue still apply. These include fees owed, data, disclaimers, limits of liability, indemnity and disputes.
20. Disclaimers
To the fullest extent the law allows, the Services are provided "as is" and "as available". MPC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that AI outputs, translations, code summaries, dose estimates or directory information are accurate or complete. We don't warrant the work, licensing, insurance or conduct of any pool company. Some states don't allow certain disclaimers, so some of these may not apply to you.
21. Limitation of liability
To the fullest extent the law allows:
- MPC isn't liable for any of the following, even if we were told they were possible:
- indirect, incidental, special, consequential, exemplary or punitive damages;
- lost profits, revenue, data or goodwill;
- damage to pools, equipment, property or health that results from using AI outputs or dose estimates without testing the water and following the product label.
- MPC's total liability for all claims relating to the Services is limited to the greater of (a) the amounts you paid MPC in the 12 months before the event giving rise to the claim, or (b) US $100.
These limits don't apply to liability that can't be limited by law, such as liability for fraud or, where the law requires, for gross negligence or wilful misconduct.
22. Indemnity
If you use Pool AI Pro as a business, you'll defend and indemnify MPC, its officers, employees and agents against third-party claims, and the related losses and reasonable legal fees, that arise from any of the following:
- your services, staff or conduct;
- your content, website or Customer Data;
- your payments, refunds, surcharges or disputes with your customers;
- your breach of these Terms or the law.
We'll tell you promptly about any such claim. We'll also let you control the defense, as long as you don't settle a claim that admits fault by MPC without our consent.
23. Governing law and disputes
Governing law. These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. If you're a consumer, this doesn't take away any protections that the law where you live gives you and that can't be waived by agreement.
Talk to us first. Most problems can be solved quickly. Before starting a formal claim, email info@mpcpoolai.com with a description of the problem and what you're asking for. Both sides then agree to try in good faith to resolve it for 30 days.
Arbitration and class-action waiver. If the dispute isn't resolved informally, you and MPC agree to resolve it by binding individual arbitration rather than in court, with these limits:
- Either side may bring an individual claim in small-claims court.
- Either side may ask a court to stop the misuse of its intellectual property.
The arbitration rules:
- The arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules.
- It will take place by video or in the county where you live or do business, unless both sides agree otherwise.
- Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
- If the class-action waiver is found unenforceable for a claim, that claim goes to court, not to arbitration.
30-day opt-out. You may opt out of this arbitration agreement by emailing info@mpcpoolai.com, with the subject "Arbitration opt-out", within 30 days of first accepting these Terms.
Courts. Any dispute that isn't arbitrated will be decided in the state or federal courts located in Florida, and both sides accept their jurisdiction.
24. Changes to these terms
We may update these Terms. When we do, we'll post the new version here and change the date at the top. If a change is significant, we'll tell you by email or in the app at least 30 days before it takes effect. If the law or a security issue requires a faster change, it may take effect sooner. If you keep using the Services after the change takes effect, you accept the new Terms. If you don't agree, stop using the Services and, if you're a company, cancel your subscription.
25. Notices and general terms
- Notices.
- We send notices to the email on your account or show them in the app.
- You can send notices to info@mpcpoolai.com or by mail to the address below.
- Entire agreement. These Terms and the policies linked here are the whole agreement between you and MPC about the Services. A separately signed agreement, such as a beta agreement, controls for its own subject.
- Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets. If we do, we'll give notice.
- Severability and no waiver. If part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we can still enforce it later.
- Events beyond our control. Neither side is responsible for delays caused by events beyond reasonable control, such as hurricanes and other severe weather, power or internet outages, or provider failures.
- Language. Pool AI may show translations of these Terms. If a translation and the English version conflict, the English version controls, unless local law requires otherwise.
